NextBrick Terms of Use

These Terms of Use ("Terms") govern your access to and use of the NextBrick mobile application and related services (together, the "App"), provided by V4 DevLabs OPC Pvt Ltd, a company incorporated in India with its place of business in Thiruvananthapuram (Trivandrum), Kerala ("NextBrick", "we", "us", "our").

By creating an account or using the App, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the App. Last updated 5 October 2026.

What NextBrick is

NextBrick is an independent construction oversight service. The App is the platform through which that service is delivered: homeowners follow their projects, supervisors record inspections and evidence, and builders manage their profile and respond to project matters. NextBrick helps verify, document and track construction work.

NextBrick is not the builder, contractor, architect, structural engineer or legal adviser on your project, unless we expressly agree otherwise in a separate written agreement. Our reports, assessments and ratings are oversight opinions based on the evidence available to us. They are not engineering certifications, statutory or building-code approvals, legal advice, or guarantees of workmanship, quality, cost or completion.

Eligibility and accounts

  • You must be at least 18 years old and capable of entering into a binding contract under Indian law.
  • Supervisor, builder and staff accounts are created or approved by NextBrick. Homeowners may register themselves and may begin as a prospective client (a "lead") before a project is activated.
  • You must give accurate, complete and current information and keep it updated. You are responsible for all activity under your account and for keeping your credentials confidential. Tell us immediately at support@v4nextbrick.com if you suspect unauthorised use.
  • We may verify your identity, role or credentials, and may refuse, suspend or close an account where information is false, incomplete or misleading, or where these Terms are breached.
  • Your access depends on your role and project assignment. You must not attempt to access information or features you have not been given.

Packages, fees and payments

Access to oversight services may depend on a package or subscription (for example, homeowner packages such as Essential, Assurance and Guardian, and builder programmes such as Verified Builder and Verified Builder Pro) agreed with us separately. Fees, billing, refunds, scope and service levels are set out in your package or service agreement, which prevails over these Terms on those matters.

Payments for NextBrick services are not processed inside the App.

NextBrick verifies milestones and payment evidence for oversight purposes, but does not hold, transfer, escrow or guarantee funds between homeowners and builders unless a separate written agreement says so. Payment obligations between a homeowner and a builder are governed solely by their own contract.

Acceptable use

You agree not to:

  • upload false, misleading, altered or fabricated photos, videos, audio, documents, locations, measurements, ratings or reports;
  • capture or upload content you have no right to, or that infringes another person's privacy, confidentiality or intellectual property rights;
  • use the App for any unlawful, fraudulent, harassing, defamatory, obscene or abusive purpose;
  • share your login credentials, or impersonate another person, organisation or role;
  • attempt to bypass access controls, or probe, scan or test the security of the App, except through a disclosure we have agreed to in writing;
  • reverse engineer, decompile, copy or create derivative works of the App, except as the law permits;
  • introduce malware, overload or disrupt the service, or use bots, scrapers or other automated means to access or extract data;
  • use evidence, ratings or builder information to harass, defame or unfairly target any person.

Supervisors and builders

Supervisors must capture evidence honestly, at the actual site and in line with NextBrick's inspection procedures. Builders must respond to issues and provide documents and information truthfully and in good time. We may remove content and act on accounts that breach this section.

Your content

"Your Content" means the photos, videos, audio, documents, messages, profile and portfolio material and other information you submit through the App.

  • You keep ownership of Your Content.
  • Licence to us. You grant NextBrick a worldwide, non-exclusive, royalty-free, sub-licensable (to our service providers only) licence to host, store, process, display, reproduce and share Your Content as needed to operate and improve the service. For example: to generate reports, to share evidence with the participants in a project, to maintain the permanent project archive, and to support audits, quality assurance and dispute resolution. This licence continues for archived project records for as long as we are required or permitted to keep them.
  • Builder profiles. Builder profiles and portfolios you submit may be shown to homeowners using the App.
  • Your confirmation. You confirm that you have the rights and permissions needed to submit Your Content, including the consent of any identifiable person in it where required by law.
  • Evidence integrity. Evidence in the App is timestamped, geo-tagged and logged. Sealed archive records are intended to be a reliable historical record and may be amended only by adding new, traceable entries.

Ratings, assessments and reports

Builders, supervisors and staff may be rated or assessed on recorded evidence. These are opinions produced by our process and may inform decisions such as builder suitability and project assignment. They are not warranties or professional certifications. If you believe a record about you is wrong, contact us at support@v4nextbrick.com and we will review it in good faith.

Permissions on your device

Some features need access to your camera, photo library, microphone, location and notifications. You decide whether to grant each permission, and the App explains why it is requested. Without a permission, related features (such as site capture) may be unavailable. The Privacy Policy explains how this data is used.

Intellectual property

The App, including its design, software, text, graphics, trademarks, names and logos, belongs to NextBrick or its licensors and is protected by Indian and international intellectual property laws. We grant you a limited, personal, revocable, non-exclusive, non-transferable licence to use the App for its intended purpose while you comply with these Terms. All rights not expressly granted are reserved.

Reports and documents we generate for your project may be used by you for your own project purposes, but may not be resold or published as a commercial service without our prior written consent.

Availability and changes

We work to keep the App available but do not guarantee uninterrupted or error-free service. Features may change, be added or be removed, and we may carry out maintenance. The App relies on third-party services, and on your device and network connection. Offline captures may be stored on your device and uploaded later; you are responsible for letting them sync.

Disclaimers

To the maximum extent permitted by law, the App and services are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that:

  • inspections will detect every defect, deviation or risk;
  • information in the App, including builder information supplied by others, is complete, accurate or current;
  • builders or other third parties will perform their obligations.

Construction risk

Construction involves inherent risk. Decisions about your project, payments and builders remain yours.

Limitation of liability

To the maximum extent permitted by law, NextBrick and its directors, employees and affiliates are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profit, revenue, data, goodwill or opportunity, arising from your use of the App.

Our total aggregate liability for any claim relating to the App is limited to the greater of (a) the fees you paid us for the relevant service in the 12 months before the claim arose, or (b) INR 10,000.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud or wilful misconduct. Liability under your package or service agreement is governed by that agreement.

Indemnity

You agree to indemnify and hold NextBrick, its directors and employees harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, Your Content, or your violation of any law or of another person's rights.

Suspension and termination

You may stop using the App and delete your account at any time: homeowners can do this in the App under Profile → Account → Delete account, and anyone can request it by emailing privacy@v4nextbrick.com. Deletion is not available while you have a project in progress, and project records are kept in anonymised form as the Privacy Policy explains. We may suspend or terminate your access immediately if you breach these Terms, if required by law, or if your access is no longer appropriate for your role or project. Provisions that by their nature should survive termination, including content licences for archived records, disclaimers, limitation of liability, indemnity and governing law, will survive.

Notices and changes to these Terms

We may update these Terms from time to time. We will post the updated version in the App or on our website and update the date above. For material changes we will give notice in the App or by email. Continuing to use the App after the effective date of a change means you accept it. If you do not agree, you must stop using the App.

Notices to you may be given in the App or to the email address on your account. Notices to us should be sent to support@v4nextbrick.com.

Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Please contact us first so we can try to resolve any dispute informally. Any dispute that is not resolved informally within 30 days is subject to the exclusive jurisdiction of the courts at Thiruvananthapuram, Kerala, India. Nothing in these Terms limits any mandatory consumer rights you may have under the law that applies to you.

General

These Terms, together with the Privacy Policy and any package or service agreement, are the entire agreement between you and NextBrick about the App. If a provision is found unenforceable, the rest remain in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of our business. No third party has rights under these Terms.
